Greetings from SilentGroveWay ("we," "our," or "us"). These Terms & Conditions ("Terms") apply to your use of our yacht rental services and the website at silentgroveway.sbs (the "Service"), provided by SilentGroveWay.
By reserving a yacht or using our Service, you consent to these Terms. Should you not agree with any section of these terms, you must refrain from using the Service.
2. Service Overview
SilentGroveWay offers exclusive yacht rental services, which include, but are not limited to:
- Day-long yacht rentals
- Evening boat tours
- Business getaways
- Private gatherings
- Extended yacht hires
Our services are subject to both availability and climatic conditions. We keep the right to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a yacht reservation, you are required to:
- Be a minimum of 18 years old
- Provide precise and comprehensive details
- Remit the necessary deposit as mentioned in your reservation confirmation
- Accept these Terms & Conditions
3.2 Confirmation
We only confirm your reservation after we receive the payment and provide a written acknowledgment. We have the discretion to deny services to anyone.
3.3 Availability
All yacht hires are dependent on the availability of the vessel and favorable weather conditions. We will strive to fulfill your preferred dates and times.
4. Payment Terms
4.1 Pricing
All quoted rates are in € and incorporate all relevant taxes unless stated otherwise. Fees are subject to modifications without prior warning.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost is due upon reservation
- Balance: Owed 48 hours prior to the departure of the charter
- Additional expenses (if applicable): Payable after the charter concludes
4.3 Payment Methods
We accept most credit cards, bank wire transfers, and certified bank checks. All payment processing is conducted using secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Above 72 hours before departure: Entire refund minus processing fees
- 24-72 hours before departure: Refund of 50%
- Under 24 hours before departure: No refund available
5.2 Weather Cancellations
In cases where weather is deemed hazardous by our captain, we will propose to:
- Reschedule your charter to a subsequent available slot without extra charges
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
If there's a mechanical malfunction with the designated yacht, we will endeavor to provide an appropriate alternative. When no such option exists, we will furnish a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Heed all instructions from the crew
- Adhere to safety equipment requirements when mandated
- Disclose any health conditions that might affect their safety
- Stay within the assigned sections of the vessel
6.2 Prohibited Items
The following items are strictly forbidden aboard:
- Glassware
- Illegal substances
- Weapons or firearms
- Limited beverage consumption (to an acceptable extent)
- Animals (unless prior approval is granted)
6.3 Conduct
Passengers are expected to behave in a respectful and orderly fashion. We reserve the authority to terminate a charter prematurely and without compensation if passenger conduct endangers safety or interferes with the experience of others.
7. Liability and Insurance
7.1 Our Liability
Our responsibility is confined to the fees you have paid for your charter. We are not accountable for:
- Personal injuries arising from the guests' carelessness
- Theft or damage to personal belongings
- Indirect, unintended, or punitive damages
- Delays due to weather or other circumstances beyond our control
7.2 Insurance Coverage
We hold comprehensive marine insurance that encompasses our vessels and operations. It is the responsibility of passengers to secure their personal and travel insurance.
7.3 Assumption of Risk
By engaging in our yacht rental services, you consent to the intrinsic dangers associated with maritime activities and take responsibility for your safety and security.
8. Modifications and Itinerary Changes
We retain the right to modify itineraries, pathways, or schedules due to meteorological conditions, security reasons, or operational demands. We will exert effort to afford equivalent alternative experiences.
9. Force Majeure
We bear no culpability for interruptions, cancellations, or alterations caused by forces beyond our control, inclusive of but not limited to:
- Extreme weather scenarios
- Natural calamities
- Regulatory enforcement
- Shut downs of harbors
- Mechanical defects
10. Privacy and Data Protection
Your personal details are managed in line with our Privacy Policy. By employing our services, you consent to the use and collection of your data as detailed in our Privacy Policy.
11. Intellectual Property
The content featured on our website, such as text, visuals, logos, and images, is shielded by copyright and trademark legislation. Unauthorized reproduction, distribution, or production of derivative works is prohibited without our explicit consent.
12. Governing Law
The governing laws of Italy apply to these Terms. Any related legal matters are to be settled exclusively in the courts within Olbia, Italy.
